Qalp: Dua & Reflection — Terms of Use (EULA)

1. Description of the App

Qalp: Dua & Reflection is an iOS application designed to support Muslim users in their spiritual journey. The App provides:

• An AI-powered dua and reflection companion for personalized spiritual guidance.
• A curated library of duas and hadiths with search and filter functionality.
• A dhikr counter for tracking remembrance practices.
• A Qibla compass for prayer direction.
• Daily reminders and inspirational content via notifications.
• Premium subscription features via Apple In-App Purchase.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement.

3. User Accounts

• You may sign in using your Apple ID or email and password.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You agree to notify us immediately of any unauthorized use of your account at hasanbarisgok@gmail.com.

4. Subscription and Payments

The App offers a free tier with limited access to AI-powered features. Free users receive a defined number of AI interactions per day.

Premium features are available through an auto-renewable subscription purchased via Apple's App Store:

• Subscription service/title: Qalp Premium.
• Plan: Yearly subscription.
• Price: $29.99/year.
• Free trial: 3-day free trial.
• Billing: Payment will be charged to your Apple ID account at confirmation of purchase.
• Renewal: The subscription automatically renews unless canceled at least 24 hours before the end of the current period.
• Renewal billing: Your Apple ID account will be charged for renewal within 24 hours before the end of the current period.
• Management and cancellation: You can manage and cancel your subscription at https://apps.apple.com/account/subscriptions.
• No refunds are provided for the unused portion of a subscription period.
• We reserve the right to change subscription pricing with reasonable notice. Continued use of the App after a price change constitutes acceptance of the new price.

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App in any way that violates applicable laws or regulations.
• Use the AI companion feature to generate harmful, offensive, or misleading content.
• Attempt to reverse-engineer, decompile, or disassemble any portion of the App.
• Use automated scripts, bots, or other means to access the App in an unauthorized manner.
• Impersonate any person or entity or misrepresent your affiliation.
• Exploit, harm, or attempt to exploit minors.
• Interfere with or disrupt the integrity or performance of the App or its servers.

6. AI-Generated Content Disclaimer

The AI companion feature provides spiritually inspired suggestions and responses based on your input. Please be aware:

• AI-generated content is for informational and reflective purposes only and does not constitute religious rulings (fatwas), scholarly opinions, or professional advice of any kind.
• We do not guarantee the accuracy, completeness, or religious correctness of AI-generated responses.
• Always consult a qualified Islamic scholar for definitive religious guidance.
• We are not responsible for any decisions made based on AI-generated content.

7. Intellectual Property

All content within the App — including but not limited to the App design, interface, source code, graphics, logos, and curated dua/hadith library — is the property of Hasan Baris Gok or its licensors and is protected by applicable intellectual property laws.

Quranic verses, hadiths, and traditional duas are sourced from public domain religious texts. We make no claim of ownership over these sacred texts.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms.

8. Third-Party Content and Services

The App may integrate with or link to third-party services (such as Supabase and OpenAI). We are not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is governed by their respective terms and policies.

9. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the practices described in the Privacy Policy.

10. Disclaimers and Limitation of Liability

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, Hasan Baris Gok shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data or content, interruption of service, or any damages resulting from reliance on AI-generated content.

Our total liability to you for any cause of action shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, us, or third parties, or is required by law or regulation.

Upon termination, your right to use the App ceases immediately.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Turkey, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date at the top of this document and displaying a notice within the App.

Your continued use of the App after the updated Terms take effect constitutes your acceptance of the new Terms.
